<h2>What is Credit Counseling, and Why do I have to do it to File a Bankruptcy?</h2>
<p>When the Bankruptcy Code was changed in 2005, a provision was added requiring debtors to complete credit counseling before filing their case.  The course must meet minimum requirements as established by each jurisdiction, and a certificate is given to each debtor upon completion.  Without the certificate, your case can be dismissed after it has been filed.  There are limited circumstances under with a debtor may get the requirement waived, but this is rare.  As such, it doesn’t warrant much discussion here.</p>
<h2>I Already Completed a Credit Counseling Course, Do I have to do it Again?</h2>
<p>You may have to complete your credit counseling again to file a Bankruptcy in Chicago.  It depends on how long ago you completed the course.  The certificate is only valid for 180 days after you have taken the course.  This is why I work with my clients to time when they should take their course.  Obviously, if you walk in to my office for a consultation and already have a certificate that we can use when filing your Bankruptcy, then every effort will be made to do so.</p>
<h2>Don’t Forget About the Second Credit Counseling Course?</h2>
<p>After you have file Bankruptcy in Chicago, you are required to complete a second credit counseling course.  This course differs from the first in many ways, and I have had clients state that it was more informative than the other course.  If you have any questions about which course you should take, your Bankruptcy Attorney can often point you in the direction of a qualifying course that is affordable and worthwhile.</p>

<p>There are several reasons to be cautious of Bankruptcy Mills in Chicago.  The first, and most important, is the fact that they tend to treat every Bankruptcy like it is a simple case.  As a result, your Bankruptcy will be broken down into its most basic steps, and treated like a factory process.  You will spend very little time meeting with a skilled Bankruptcy Attorney, and most likely vital details will be missed.  Even worse, you may be asked to sign very important paperwork without ever first discussing what it means with your Attorney.</p>
<p>Without attention to detail, your case can turn ugly in an instant, and you can end up being penalized by the Bankruptcy Court.  After all, it is your life that is on the line here.  A Bankruptcy Mill Attorney in Chicago isn’t concerned with making sure your case is done to the best of his or her abilities.  Rather, they only want to move you through the system as fast as possible to ensure the highest profit.</p>
<h2>Why Should You Avoid a Bankruptcy Mill?</h2>
<p>One thing that I have learned over the years is that every Bankruptcy client that walks through my door has a unique case, and there is no simple case.  Bankruptcy Mills usually create simple system to handle all cases.  This system will not handle the complications that exist in every case, and tends to miss details.  Additionally, Bankruptcy Mills simply do not provide the level of customer care that I believe in.  At a Chicago Bankruptcy Mill, the Attorneys just don’t have the time to devote the attention necessary to every case because you are one case among the hundreds that they handle at once.</p>

<p>As a Chicago Bankruptcy Attorney, when I file a Bankruptcy for a client, I make sure that each creditor is disclosed within the paperwork filed with the court.  Additionally, I see to it that the proper address for each creditor is also included.  This way the court is able to send Notice to each creditor that you filed  Bankruptcy.  This Notice is 100% necessary.  Without it, you will not be able to punish a creditor that has violated the Stay.  A good Chicago Bankruptcy Attorney keeps a list of addresses for regular creditors that are included in most Bankruptcies.  Additionally, a Chicago Bankruptcy Attorney should pull your credit bureau report to make sure that all of your creditors have been included with the proper address.</p>
<h3><strong>Your Chicago Bankruptcy Attorney should Enforce the Automatic Stay when Creditors Violate it.</strong></h3>
<p>After your case has been filed, you should notify your Chicago Bankruptcy Attorney if creditors continue to contact you.  Even calling you on the phone is considered a violation of the Stay and can be punished by seeking a fine in court.  Your Chicago Bankruptcy Attorneys should start by sending a letter to the creditor demanding that they stop all contact, and the Attorney may even demand money to offset Attorney fees due to the contact.  If the creditor continues to contact you after the attorney has sent a letter, legal action should follow.  Your Chicago Bankruptcy Attorney should file a complaint for damages within your Bankruptcy against the creditor.</p>
